These conditions govern purchases made on the www.brumilano.it site, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree n. 21/2014 and by Legislative Decree 70/2003 concerning electronic commerce.

Object of contract
With these general conditions of sale, BRÙ sells and the customer purchases remotely the movable tangible assets indicated and offered for sale on the site www.brumilano.it. The contract is concluded exclusively through the internet, through the access of the customer to the address www.brumilano.it and the realization of a purchase order according to the procedure foreseen by the site itself.

The customer undertakes to read these general conditions of sale before confirming their order.

Pre-contractual information for the consumer – art. 49 of Legislative Decree 206/2005
The customer before the conclusion of the purchase contract, sees the characteristics of the goods that are illustrated in the product pages at the time of the choice.

Before the conclusion of the purchase contract and before the validation of the order with “payment obligation”, the customer is informed regarding:

– total price of the goods including taxes, with details of shipping costs and any other costs;
– terms of payment;
– conditions, terms and procedures to exercise the right of withdrawal;
– information that the customer will have to bear the cost of returning the goods in case of withdrawal;

Conclusion and effectiveness of the contract
The sales contract is considered concluded with the sending by BRÙ to the customer of an e-mail confirming the payment. The e-mail contains the customer’s data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent.

The customer undertakes to verify the correctness of the personal data contained therein and to promptly notify BRÙ of any corrections.

BRÙ undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may emerge. Furthermore the photographs of the products presented on www.brumilano.it do not constitute a contractual element, as they are only representative.

Product availability
Product availability refers to actual availability at the time the customer places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of several users, the products could be sold to other customers before the order is confirmed.
Even after sending the order confirmation email sent by BRÙ, there may be cases of partial or total unavailability of the goods. In this case, the customer will be immediately informed by e-mail.
If the customer requests the cancellation of the order, resolving the contract, BRÙ will reimburse the amount paid within 14 days from the day in which it became aware of the customer’s decision to terminate the contract.

Terms of payment

At the time of purchase, customers enter their credit card details in a secure electronic banking system.
You can make purchases using Visa, Mastercard, American Express and Postepay.
All transactions are processed through a secure server, guaranteeing BRÙ customers maximum data protection.
The BRÙ customer service operators are in no way authorized to request or accept credit card numbers and / or extremes of validity thereof.
In order to ensure greater protection on purchases made in e-commerce, BRÙ recommends its customers to join the services Verified By Visa or Mastercard Securecode, requesting a PIN security code with which they can make their purchases in complete safety.

Security of payment
In order to prevent internet fraud, payment for orders made on www.brumilano.it is managed online by the bank concerned through its secure servers. The bank concerned is responsible for the storage and automatic processing in a protected environment of information relating to each order, including financial information. All financial information, such as credit card number, expiration date, etc., is directly managed by the bank concerned which guarantees the security of online transactions.
BRÙ is not aware of the credit card details and is therefore unable to store them or store them in any way.

Prices
All the selling prices of the products indicated on the site www.brumilano.it are expressed in Euro.
Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before payment is made.
The customer accepts the faculty of BRÙ to change its prices at any time, however the goods will be invoiced based on the prices indicated on the site at the time of order creation and indicated in the confirmation email sent by BRÙ to the customer.

Right of withdrawal
In accordance with the legal provisions in force, the customer has the right to withdraw from the purchase without any penalty and without specifying the reason, within a period of 14 days from the date of receipt of the products.

The customer who intends to exercise the right of withdrawal must notify BRÙ by an explicit declaration, which can be communicated via email to the address: customerservice@brumilano.it.

In case of exercise of the right of withdrawal, the customer is required to return the goods within 14 days from the day on which he communicated to BRÙ his intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.

The direct costs of returning the products are charged to the customer.

The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, BRÙ will reimburse the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.

As required by art. 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, BRÙ may suspend repayment until receipt of the goods. BRÙ will carry out the refund using the same payment method chosen by the customer during the purchase phase.

Legal guarantee of conformity
In the case of receipt of products that do not comply with the orders or are defective, the customer has the right to restore the cost of the product by repairing or replacing the product without charge.
For wrongly ordered goods, the customer can contact BRÙ, communicate the error and define the methods for the supply return; we will proceed to credit and / or replacement only after receipt of the return.

Commercial guarantee
All the products presented on the website www.brumilano.it benefit, in addition to the legal guarantee of conformity referred to in the previous article, from a commercial guarantee whose duration is mentioned on the product data sheets of the articles.
To use the warranty, the customer must keep the purchase invoice.

Delivery methods
BRÙ will only accept orders to be delivered in the territories indicated within the site. The products will be delivered by express courier to the address indicated by the customer at the time of ordering on average 4/5 working days.

Responsability
BRÙ assumes no responsibility for disruptions caused by force majeure or unforeseeable circumstances, even when dependent on malfunctions and disruptions of the internet, in the event that it fails to execute the order within the time stipulated in the contract.
